These Terms of Service ("Terms") govern your access to and use of the websites operated by Simard Construction LLC, including simardconstruction.com and simardroofing.com (the "Site"). By using the Site or submitting a quote request, you agree to these Terms.

1. About Us

Simard Construction LLC is a licensed Florida certified building contractor (License CBC1266457). Roofing services are provided by Simard Roofing LLC, a licensed Florida roofing contractor (License CCC1337492). Both entities are referred to as "Simard Construction," "we," or "us" in these Terms.

2. Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

• Submit false, misleading, or fraudulent information.
• Attempt to gain unauthorized access to any part of the Site.
• Copy, scrape, or republish Site content without written permission.
• Interfere with or disrupt the Site's operation.

3. Quote Requests Are Not a Contract

Submitting the quote form or contacting us by phone, email, or chat begins a conversation. It does not create a binding construction contract, a guarantee of pricing, or a commitment to perform work. All construction work is performed only under a separate written agreement signed by both parties, which will control scope, price, schedule, warranties, and change orders.

4. Communications

By providing your phone number and email through the quote form, you agree that we (and our lead-management system) may contact you about your project by phone call, text message, and email. You may opt out of marketing messages at any time by replying "STOP" to a text or by emailing info@simardconstruction.com. Standard message and data rates may apply.

5. Intellectual Property

All content on the Site — including the Simard Construction and Simard Roofing names, logos, photography, project images, text, and layout — is owned by Simard Construction LLC or its licensors and is protected by U.S. copyright and trademark law. You may not reproduce or use this content for commercial purposes without our prior written consent.

6. Third-Party Links & Tools

The Site may link to third-party websites (for example, our Google Business profile, Instagram, TikTok, and JobTread quote form). We are not responsible for the content, policies, or practices of those third parties.

7. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Information on the Site is for general informational purposes and is not a substitute for a written estimate or construction contract.

8. Limitation of Liability

To the fullest extent permitted by Florida law, Simard Construction LLC and Simard Roofing LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. Our total aggregate liability arising from your use of the Site is limited to one hundred U.S. dollars (US $100). This section does not limit any rights or remedies related to actual construction services, which are governed by your signed construction contract.

9. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in St. Lucie County, Florida, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms at any time. The "Effective date" at the top of this page will reflect the most recent version. Continued use of the Site after changes means you accept the updated Terms.
